The footer of this "fake" band includes the subreport. You may also need to make a few settings as to the stretching of the subreport. This way, is the subreport is empty, it should not take up any space. I have not tried this solution, but it seems like it would work. BTW, you may have to set the displayType of the supreport to NoPages so that nothing is produced when there are no records.
